Supreme Court stays proceedings against Avnish Bajaj

The Supreme Court has stayed proceedings against eBay India chairman Avnish Bajaj for allegedly allowing an obscene MMS clip involving two DPS students to be uploaded on Baazee.com, where he was then managing director. The court has also asked Delhi Police why proceedings against Bajaj should not be quashed.

In an appeal filed before the apex court, Avnish Bajaj contended that mere listing could not be construed as crime under the IT Act. In its judgement delivered on May 29, 2008, the Delhi High Court had quashed the proceedings against Avnish Bajaj under Indian Penal Code (IPC) but had permitted prosecution under the IT Act.
