High Court declines to drop entire chargesheet against Avnish Bajaj

Delhi High Court has declined to quash the entire chargesheet against Avnish Bajaj, former managing director of Bazee.com India (now eBay India), in the infamous MMS (multimedia messaging service) case.

In December 2004, Delhi Police had registered an FIR against Avnish Bajaj and his company Bazee.com for illegally displaying a video clip, which was recorded on a mobile phone camera and showed two school students indulging in a sexual act.

While dropping sections 292 (selling of obscene material) and 294 (obscene act) under IPC (Indian Penal Code), Justice S Muralidhar made it clear that the case under the Information and Technology Act, for selling the video clip, would continue against Bajaj. [Source: Economic Times]
